NOTICE WITH RESPECT TO 18 U.S.C. § 2257
The operator of this Web site does not maintain any records with respect to any of the visual depictions on this Web site for the following reasons with respect to each visual depiction:
(1)(a) The visual depiction was created prior to July 27, 2006 and does not constitute a visual depiction of sexually explicit conduct as defined by clauses (i) through (iv) of section 18 U.S. C. § 2256(2)(A); and/or
(b) The visual depiction does not does not constitute a visual depiction of sexually explicit conduct as defined by clauses (i) through (v) of section 18 U.S. C. § 2256(2)(A); or
(2) The visual depiction was posted by a subscriber and this Web site therefore did not “produce” the visual depiction, as that term is defined in 18 U.S.C. § 2257(h)(2), because one or more the following exceptions are applicable with respect to the visual depiction:
(a) This Web site is engaged in “the provision of a telecommunications service, or of an Internet access service or Internet information location tool (as those terms are defined in section 231 of the Communications Act of 1934 (47 U.S.C. 231))” as found in 18 U.S.C. § 2257(h)(2)(B)(iv); and/or
(b) This Web site is engaged in “the transmission, storage, retrieval, hosting, formatting, or translation (or any combination thereof) of a communication, without selection or alteration of the content of the communication, except that deletion of a particular communication or material made by another person in a manner consistent with 230(c) of the Communications Act of 1934 (47 U.S.C. 230(c)) shall not constitute such selection or alteration of the content of the communication” as found in 18 U.S.C. § 2257(h)(2)(B)(v).
